This course is different from the original ethics class LOs took for their first year renewal in 2007 and 2008.
Case Studies in Ethics, Fraud, Consumer Protection, and Fair Housing
In this course we will review court decisions involving mortgage brokers and whether the judge or jury felt the broker/ loan originator provided the standard of care required of those who provide professional services to the public. We will see how new trends in the law require brokers and LOs to exercise considerable effort in meeting fiduciary responsibilities, and we will learn intermediate to advanced ethics concepts.
Two informative court cases will be assigned for student evaluation: Carnell v. KMC Mortgage Company – on ethics, consumer fraud, and fiduciary responsibility; and the N.A.A.C.P. v. Novastar Financial, et al, – on ethics, discrimination and fair lending laws. Students will argue both sides and reach a verdict.
This course satisfies the ethics portion for loan originator license renewal.
